Welcome to QBERX. These Terms of Service ("Terms") govern your use of the QBERX platform and services operated by QBERX ("we", "us", or "our"). By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using QBERX services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Description of Service

QBERX is a financial technology company that provides:

  • Turnkey fintech development and system integration
  • AI-powered technology tools for financial institutions
  • Regulatory intelligence through the QRegu platform
  • Mobile applications for iOS and Android
  • Compliance and reporting tools

3. Account Registration

To use QBERX services, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Be at least 18 years old
  • Have authority to bind your organization (if applicable)

You are responsible for all activities under your account.

4. Subscription and Payment

4.1 Plans

QBERX offers various service plans with different features and pricing. Current plans and pricing are available at qberx.com/#pricing.

4.2 Billing

  • Subscriptions are billed monthly or annually in advance
  • Prices are in USD unless otherwise specified
  • All fees are non-refundable unless otherwise stated

4.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time.

5. Acceptable Use

You agree not to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Attempt to gain unauthorized access to our systems
  • Transmit malware or harmful code
  • Use the service for competitive analysis or benchmarking
  • Resell or redistribute the service without authorization
  • Interfere with or disrupt the service

6. Intellectual Property

6.1 Our Property

QBERX, including its software, design, logos, and content, is owned by QBERX and protected by intellectual property laws. You receive a limited, non-exclusive license to use the service.

6.2 Your Content

You retain ownership of data you upload to QBERX services. You grant us a license to use this data solely to provide the service.

7. Data and Privacy

Your use of QBERX services is subject to our Privacy Policy, which describes how we collect, use, and protect your data.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may:

  • Perform scheduled maintenance (with advance notice when possible)
  • Experience occasional outages due to technical issues
  • Modify or discontinue features with reasonable notice

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • QBERX services are provided "as is" without warranties of any kind
  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid us in the 12 months prior to the claim
  • We are not liable for regulatory decisions or compliance outcomes

10. Indemnification

You agree to indemnify and hold QBERX harmless from any claims, damages, or expenses arising from your use of the service or violation of these Terms.

11. Termination

We may suspend or terminate your account if you:

  • Violate these Terms
  • Fail to pay applicable fees
  • Engage in fraudulent or illegal activity

Upon termination, your right to use the service ceases immediately. You may request export of your data within 30 days.

12. Governing Law

These Terms are governed by the laws of the Republic of Turkey. Any disputes shall be resolved in the courts of Istanbul, Turkey.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use after changes constitutes acceptance.

14. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and QBERX
  • Severability: If any provision is found invalid, the remaining provisions remain in effect
  • Waiver: Failure to enforce any right does not waive that right
  • Assignment: You may not assign these Terms without our consent
